Privacy Policy
This policy explains how James MacKellar, trading as James MacKellar Tutoring, collects and handles personal data. James is the data controller for the information described here.
What data is collected
When you send an enquiry, the form collects:
- Your name and email address.
- Your phone number, if you choose to give one — it is optional.
- Whether you are a parent or a student, and the subject and level you are asking about.
- How you heard about James, if you choose to answer — this is optional and is only used to understand which channels are worth continuing.
- Whatever you write in the message box.
If you sign up for updates, only your email address is collected. Nothing more than the above is gathered, and there is no tracking or profiling on this site.
Why it is collected, and the legal basis
- To reply to your enquiry and arrange a consultation. Legal basis: taking steps at your request before entering into a contract.
- To send updates you asked for. Legal basis: your consent, which you can withdraw at any time.
- To keep records of tutoring arranged and paid for. Legal basis: legitimate interests and, where applicable, legal obligation.
Students under 18
Most students James teaches are under 18, and their data is treated with extra care.
- Where a student is under 18, James asks that a parent or guardian makes the enquiry and is the person he contracts with.
- James does not knowingly collect personal data directly from a child without a parent or guardian's involvement. If you believe a child has sent information through this site without that, contact James at jamesmackellar05@gmail.com and it will be deleted.
- Session notes about a student are kept to what is needed to teach them well — topics covered and what to work on next.
- A parent or guardian may ask to see, correct, or delete anything held about their child at any time.
How long it is kept
- Enquiries that do not lead to tutoring are deleted within 12 months.
- Records for current students are kept while tutoring is ongoing and for 12 months afterwards.
- Records needed for tax purposes are kept for six years, as HMRC requires.
- Update subscriptions are kept until you unsubscribe.
Who data is shared with
Your data is never sold. The only third parties involved are the services used to run this site and the tutoring:
- Formspree — processes enquiry form submissions and passes them to James by email.
- Email and video-call providers — used to reply to you and to run sessions.
Data may also be disclosed where the law requires it, including any safeguarding obligation.
Cookies
This site sets no cookies and runs no analytics or advertising trackers. See the Cookie Policy for the detail.
Your rights
Under UK GDPR you have the right to access your data, to have it corrected or deleted, to restrict or object to how it is used, and to withdraw consent at any time. To exercise any of these, email jamesmackellar05@gmail.com. You will get a reply within one month.
If you are unhappy with how your data has been handled you can complain to the Information Commissioner's Office at ico.org.uk.
