Terms of Service

These terms cover this website and one-to-one tutoring with James MacKellar, trading as James MacKellar Tutoring — a sole trader based in Bristol. They are written to say plainly what is already promised across this site, not to add anything to it.

Who the agreement is with

Most students are under 18. Where that is the case, a parent or guardian makes the booking, is the person James arranges and discusses sessions with, and is responsible for payment. You need to be 18 or over to book tutoring.

What the tutoring is

  • One-to-one 60-minute sessions in GCSE and A-level Maths, Physics and Computer Science.
  • Online over video call, or in person at the student's home in Bristol and within about 5 miles.
  • A free 30-minute first lesson, so you can see the teaching before paying for anything.
  • James teaches — he does not write coursework, complete an NEA, or do assessed work on a student's behalf. Helping a student understand their own work is the job; producing it for them is not, and he will say no.

Booking, changing and cancelling

  • Sessions are usually at the same time each week, so they become a routine. You get a calendar invite.
  • There is no minimum commitment and no notice period. Stop whenever you like — tell James and stop; there is nothing to cancel.
  • To move or cancel a single session, tell James as early as you reasonably can. There is no charge for cancelling, late or otherwise.
  • If James has to cancel, he will rearrange at a time that suits you, and you are not charged for a session that did not happen.
  • If he does not think he is the right person to help, he will say so rather than keep taking the money.

Fees and payment

  • £30 per hour for an online session, or £35 per hour in person in Bristol.
  • Payment is by bank transfer after each session. Nothing upfront, no subscription, no agency fee.
  • If the first paid session isn't worth it, you don't pay for it. This applies to your first paid session. There is no form and no conditions — tell James and you do not pay for it.
  • The prepaid block of 6 sessions for £165 is optional, against the £180 those sessions cost one at a time. It is paid in advance, and any sessions you have not used are refunded if you stop.
  • Prices can change, but never for sessions already arranged. You will be told before a change affects you.

What tutoring can and cannot promise

No tutor can promise a grade, and James does not. What is on offer is preparation, honest feedback on where a student actually is, and the work needed to close the gap. Results depend on the student, the exam, and a good deal outside anyone's control.

Safeguarding

These are commitments, not preferences. They apply whether or not you ask about them.

  • James holds an Enhanced DBS check, including the children’s barred list.
  • In-person sessions take place at the student's home, never at James's, and a parent or guardian is in the house throughout.
  • James does not transport students anywhere.
  • James does not message under-18s directly. WhatsApp and phone contact are for parents and guardians.
  • If something raises a genuine concern about a child's safety, James may have to pass it on to the appropriate authority. He would not be able to promise to keep that confidential. See the Privacy Policy for how data is handled.

What is expected from your side

  • For online sessions: a device with a working camera and microphone, a reasonable connection, and a quiet place to work.
  • For in-person sessions: a suitable place to work, with a parent or guardian in the house.
  • Turning up, roughly on time, and having a go at what was agreed between sessions.
  • Ordinary courtesy, both ways. James can end the arrangement if a student or a parent is abusive, and would tell you why.

This website and the free resources

  • Everything free on this site is free to use for your own study or your child's. It is provided as it is, with no promise that it is complete or error-free.
  • Exam boards differ and specifications change. Check anything here against your own board's current specification — it is a study aid, not a syllabus.
  • The AI Study Tutor is hosted on GitHub and is governed by the licence in that repository. It is a study tool, not a marking service, and like any AI tool it can be confidently wrong — check what it tells you.
  • The writing, worksheets and materials on this site are James's work. Use them for personal study; do not republish or sell them.
  • Please do not attempt to disrupt, break into, or bulk-scrape this site.

Where this site links somewhere else, that content is not James's and he is not responsible for it.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited. Beyond that, James is not liable for indirect losses — including exam results, missed offers, or consequences that follow from them.

These terms do not affect your statutory rights as a consumer.

Changes to these terms

These terms may be updated. The date at the top says when they last changed, and current students and parents will be told directly if something material changes.

Complaints, and the law that applies

If something has gone wrong, email jamesmackellar05@gmail.com first — most things are fixable that way, and you will get a reply within a few days. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
